§ 2 Storage possibility and inspection of the contract text

§ 2.1 Our General Terms and Conditions of Business can be viewed at www.ges-bo.de together with all the contractual provisions contained therein. Apart from that, the General Terms and Conditions can be printed or saved by using an internet service program (so-called browser -> there under "File" -> "Print" or -> "Save as"). A PDF version of our General Terms and Conditions can be downloaded and archived here. To open the PDF file, the free program Adobe Reader (www.adobe.de) or similar programs that have compatibility with the PDF format is required.

§ 2.2 The data of the order can be archived in two ways. On the one hand, it is possible to download the General Terms and Conditions and save the data summarized on the last page of the order process in the Online Shop using the functions of the browser. On the other hand, it is also possible to wait for the automatic confirmation of receipt of the order, which is automatically sent to the customer by e-mail to the e-mail address provided after the order has been completed. This confirmation contains again all data of the order and the general terms and conditions, which can be easily saved or printed via the respective eMail client.

§ 2.3 All order data are stored by us. However, for security reasons, they cannot be retrieved directly by the customer. Rather, the customer has the option of viewing all orders and order data via password-protected access ("My User Account") upon appropriate registration. Furthermore, address data can also be stored and managed. The customer undertakes to treat the personal access data confidentially and not to make it accessible to any unauthorized third party.

§ 3 Conclusion of contract

§ 3.1 The product presentations in our online store serve only as an invitation to submit a purchase offer. By clicking the [Buy] button, you are making a binding purchase offer.

§ 3.2 We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days. The confirmation of the receipt of the order does not constitute an acceptance of the purchase offer.

§ 3.3 Should our e-mail confirmation contain typographical or printing errors or should our price determination be based on technical transmission errors, we shall be entitled to contest the order, whereby we must prove our error to you. Payments already made will be refunded to you immediately.

§ 3.4 Contracts in our online store can currently only be concluded in German and English.

§ 4 Prices

§ 4.1 The prices stated on the product pages include the statutory value added tax and other price components and do not include postage.

§ 4.2 The deduction of discounts requires special written agreement.

§ 4.3 The minimum order value is € 25.00. Orders below a total value of € 25.00 are not possible.

§ 5 Shipping costs

Germany

If the value of goods is less than € 99,- we charge € 5,90 for shipping.
From a value of goods of € 99, - we ship free of charge, except for deliveries by cash on delivery.

At your request, we also carry out partial deliveries. The additional shipping costs will be charged to you - after consultation.

In the case of a delivery by cash on delivery, an additional fee of 4.90 EUR will be charged.

The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system and on the order page.

Our foreign freight charges

For delivery to zone 1 countries we charge shipping costs in the amount of € 19.90. If the value of goods is above the freight allowance, the delivery is free of shipping costs.

For delivery to the countries of zone 2 we charge shipping costs in the amount of 39,90 €. If the value of goods is above the freight allowance, the delivery is free of shipping costs.

For delivery to zone 3 countries we charge shipping costs in the amount of 79,90 €. If the value of goods is above the freight allowance, the delivery is free of shipping costs.

§ 6 Terms of delivery and self-delivery reservation

§ 6.1 Delivery is usually made with our shipping partner UPS.

§ 6.2 Unless otherwise stated in the offer, the delivery time is approx. 3-5 days. The delivery times are based in particular on the delivery times of our suppliers. If our delivery times are actually significantly exceeded, we will inform the buyer immediately.

§ 6.3 Should the delivery of the goods fail despite three delivery attempts, we can withdraw from the contract. Any payments made will be refunded immediately.

§ 6.4 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately reimburse you for any payments already made.

§ 6.5 The delivery of lamps is generally made without illuminants, unless otherwise specified in the article description.

§ 7 Right of withdrawal

§ 7.1 Consumers have a right of withdrawal according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor his independent professional activity:

§ 7.2 The right of withdrawal does not apply to the delivery of goods that are made to customer specifications or clearly tailored to personal needs.

§ 7.3 Please avoid damage and contamination. If possible, please return the goods to us with all accessories and with all packaging components. If necessary, use a protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage in order to avoid claims for damages due to defective packaging.

§ 7.4 As soon as you have declared the revocation to us, we will have the goods collected from you by our shipping partner UPS.

§ 7.5 Please note that the modalities mentioned in paragraphs § 7.3 and § 7.4 are not a prerequisite for the effective exercise of the right of withdrawal.

§ 8 Terms of payment

§ 8.1 The following payment methods are offered:

Payment in advance

Unless otherwise agreed, our invoices shall be payable in advance. In the case of payment in advance, payment shall be made within two weeks of receipt of our confirmation of receipt of the order. The date of receipt of the money by GES is decisive.

Payment via PayPal Plus

Within the framework of the PayPal Plus payment service, we offer you various payment methods as a PayPal service. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal. You will receive additional instructions during the ordering process.

You must, in order to pay the invoice amount, be registered with PayPal or register first and legitimize with your access data. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment instruction.

You do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out by your credit card company immediately after confirmation of the payment instruction and after your legitimation as a legitimate cardholder at the request of PayPal and your card will be charged.

You do not need to be registered with PayPal to pay the invoice amount. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.

You do not need to be registered with PayPal to pay the invoice amount. After successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only pay PayPal with debt-discharging effect. Payment by installments Powered by PayPal
Installment Payment Powered by PayPal allows you to pay in monthly installments (subject to availability & credit check). The installment payment is available for orders that have an order value between 99€ and 5000€. You will receive your order according to our delivery times stated in the store, because you do not have to go to the post office or bank for identification and the goods can be shipped or ordered directly. The payment service provider PayPal performs a credit check and processes the application procedure for the installment payment. Your creditworthiness is checked by PayPal in real time and you know immediately whether payment by installments is possible for you. You conclude the installment payment contract with our store. We assign the payment claim to PayPal and PayPal will collect it in its own name. However, we remain your contract and contact person. Payment by cash on delivery
The invoice amount is collected in cash on delivery by the parcel delivery company or the carrier on our behalf. In case of cash on delivery payment, a cash on delivery fee of 4,90 EUR will be charged. Payment by cash on delivery is only possible in Germany.

Payment by credit card
We accept credit cards from MasterCard and VISA. When paying by credit card, your credit card account will be charged at the time of ordering. Payment by GIROPAY or Sofortüberweisung

Payment with Amazon
For this payment method you need an activated Amazon customer account. If you click on the button "Pay with Amazon" in the checkout, shopping cart or minicart, a popup will open asking you to log in with your Amazon account details. This will inform you that Amazon Payments will use your Amazon account information to identify you, complete your purchases, and that by logging in you agree to Amazon's User Agreement and Privacy Policy.After the login process, you will have access to your shipping and payment information on file with Amazon and will be able to instruct the order on an overview page. § 9 Retention of title

The goods remain our property until full payment has been received. Before transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without our consent.

§ 10 Damage in transit

§ 10.1 If goods are delivered with obvious transport damage, please claim such defects immediately to the deliverer and contact us as soon as possible (0234-5165600 or info@ges-bo.com).

§ 10.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our claims against the carrier or the transport insurance.

§ 11 Liability for defects

The statutory liability for defects shall apply.

§ 12 Liability

We exclude our liability for slightly negligent breaches of duty, insofar as these do not concern essential contractual duties, damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act are affected. The same applies to breaches of duty by our vicarious agents.

§ 13 Final Provisions

§ 13.1 German law shall apply. In the case of contracts with consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.

§ 13.2 In case of doubt, the General Terms and Conditions in German shall apply.
